Minister Duigan has admitted on the record that the Tasmanian Government deliberately withheld information from the Commonwealth during Marinus Link negotiations, securing millions in funding by keeping the federal government from scrutinising Hydro Tasmania’s finances.
This is not a minor oversight. It is an admission that the Commonwealth was misled in negotiations worth billions of dollars of public money.

The federal government has a responsibility to its own taxpayers to find out what it agreed to, and why it did not demand full transparency before committing funding.

Prime Minister Albanese, Minister Bowen and Minister Gallagher must now answer for whether due diligence was ever done, and whether the agreement contains any protections against exactly this kind of deception.

I am writing a letter to ask you to investigate why your government did not do due diligence in the negotiations with the Tasmanian Government in relation to Battery of the Nation, Marinus Link and the North West Transmission Line, given that the Tasmanian Minister Duigan now admits that the Tasmanian government misled and deceived the Commonwealth when he said:
 
“We felt that the benefit of keeping that information private and not giving the Commonwealth the opportunity to look under the hood of Hydro was worth not putting that information in the public realm.  We’re talking about millions upon millions of dollars year on year that we were able to secure in that last piece of those negotiations. And it was agreed that we wouldn’t jeopardise those negotiations by releasing information that might run counter to those aims.”
 
Will you now do a full investigation into how this has been allowed to occur?
 
Will you reveal whether the agreement has a warning clause that misleading and deceiving the Commonwealth in an offence?
 
Finally, will you now stop any funding flow to Tasmania until the whole of government business case is released unredacted for appropriate analysis?
